1. Data controller & scope

Dexilion SZOLGÁLTATÓ KORLÁTOLT FELELŐSSÉGŰ TÁRSASÁG (Tax ID: HU32698031 Kisgömb utca 17, Budapest, Hungary, H-1135, email: [email protected]) is the data controller for the personal information processed through our websites and services.

Nothwithstanding, note that when we provide our services, your organization controls the information processed. This policy does not apply to the extent we process personal information in the role of a processor on behalf of your organization. For additional information, please consult the Data Processor Agreement included in the Terms of Service.

This policy applies to personal information processed by Dexilion across our websites (e.g. lastest.cloud, and any other domains we own or operate), mobile applications, and related services (collectively, the "Services").

2. Information we collect

We collect personal information in the following ways:

1. Information You Provide Directly

When you register, contact us, subscribe, make purchases, or participate in activities, we may collect:

• Name, email address, username, password, contact preferences
• Organization/employer details and job title
• Payment information (processed securely by third parties, e.g. Creem)
• Communications, survey responses, or contest entries
• Data submitted via contact forms or registration portals

You may not, when providing any information that may be requested from you, choose expressions that are offensive, coinciding with brands, tradenames, names or pseudonyms of public figures or celebrities for whose use you are not authorized.

It is essential that you keep your reference data, passwords and access codes generated at all times. You will be solely responsible for the use of your personal account, and in this respect you undertake to make diligent use of this information, not to make it available to third parties, and to inform us, without delay, of its loss or theft.

In order to ensure that the information provided is always up to date and free of errors, you must notify Dexilion as soon as possible of any changes to your personal data by sending an e-mail to the e-mail address: [email protected]

Likewise, by clicking on the "I accept" (or equivalent) button incorporated in the aforementioned forms, you declare that the information and data you have provided are accurate and truthful.

2. Information Collected Automatically

When you visit or use our Services, we automatically collect:

We consider that all the data processed by Dexilion has been provided to us freely.

In the event that the personal data provided is from a third person, you guarantee that you have informed them of this Privacy Policy and have obtained their authorisation to provide the data to Dexilion for the purposes indicated above. You also guarantee that the information provided is accurate and up to date, and you are responsible for any direct or indirect damage or harm that may be caused as a result of non-compliance with this obligation.

4. Legal bases for processing

For our users who are located in the EU or UK, we may rely on the following legal bases to process your personal information:

• Consent. We may process your information if you have given us permission (i.e., consent) to use your personal information for a specific purpose. You can withdraw your consent at any time. Learn more about withdrawing your consent.

• Performance of a Contract. We may process your personal information when we believe it is necessary to fulfill our contractual obligations to you, including providing our Services or at your request prior to entering into a contract with you.

5. Purposes of the processing of personal data

Dexilion acts as the controller of the personal data for the following purposes:

• Based on the management of the contractual or precontractual relationship: a) To manage the acquisition of the products that we offer on our Website and Services and to attend to any type of incident or request derived from the same, and carry out any management related to after-sales service. b) To manage your registration as a representative of an organization on our website, as well as allow your access to the private area. c) To provide you with the services you have requested.

• Based on the existence of a legitimate interest of Dexilion: a) To keep you informed about the products and services of Dexilion, as well as to send you news, events and other activities that we carry out in Dexilion, by conventional and/or electronic means (e-mails, SMS, ...), related to the products or services that we carry out and that may be of your interest. b) To carry out periodic reviews of our services and carry out satisfaction surveys in order to evaluate and improve the quality of the service we provide. c) Carry out internal reviews and, if necessary, contact the client in the event that a possible fraud or identity theft is detected or there are well-founded suspicions. d) Answer any request of information, doubt, etc we make us know through the contact channels. e) Comply with legal, regulatory, and tax obligations

• Based on the legal obligations of Dexilion: a) Provide an answer to the right's request made by the representatives of the organizations. b) Comply with all legal obligations imposed to Dexilion.

• On the basis of the explicit, free and unequivocal consent that you give us at the time of collecting your data: a) If applicable, to keep you informed about products and services of third parties, always sent through Dexilion and provided that you have given us your explicit consent to do so, by conventional and/or electronic means (emails, SMS, ...), b) if applicable, to manage and ensure your participation in a prize draw, c) if applicable, to manage the suitability of potential candidates to fill employment positions.

6. Data transfers and international transfers

All transfers of personal data that we carry out are necessary for the fulfilment of the above-mentioned purposes, or are made in order to fulfil a legal obligation:

• a) To public administrations and the administration of justice, and to law enforcement agencies in compliance with the legal obligations applicable to us.
• b) Companies providing payment services (banks, payment gateways, etc.), in case the customer makes a payment through the service offered by one of these companies.
• c) Companies providing IT services, tools or IT infrastructure on which the services provided by Dexilion are based, such as hosting providers, CRMs, emailing service companies, etc.

In this regard, we inform you that any transfer will be made taking into account all the necessary legal safeguards. We also guarantee that we sign specific contracts with all our service providers as established by the regulations.

Furthermore, Dexilion guarantees that the necessary safeguards are in place to ensure that the data can be transferred securely, either because the provider offers adequate guarantees, through, among others, signing of Standard Contractual Clauses of the European Commission, or any of the exceptions contained in the regulations.

7. Exercising your rights

In some regions (like the EEA, UK, Switzerland, and Canada), you have the following rights under applicable data protection laws. These include:

• Access & Portability: Request a copy of your data and receive it in a structured, machine-readable format.
• Rectification: Correct inaccurate or incomplete personal information.
• Erasure (Right to be Forgotten): Request deletion of your data, subject to legal exceptions.

• Object: Object to processing based on legitimate interest or direct marketing.
• Withdraw Consent: Revoke consent at any time without explanation. Please note that it will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Marketing Opt-Out: Unsubscribe via the link in any marketing email, or contact us directly. Service-related communications (security, account updates, legal notices) will continue.

Account Termination: You may update or delete your account at any time through your dashboard. Upon deletion, we will deactivate your account and remove active data, retaining only what is legally required.

8. Retention periods and Cookies.

We will only keep your data for as long as the commercial relationship is maintained, your account exists or its elimination is not requested by the data subject. Any of the data you provide us through the channels will be held as long as they are no longer necessary to manage the service and will only be available if there is a legal obligation (derived from a request from the appropriate authorities) and when you exercise your rights.

Regarding the personal data obtained through the potential candidates, for a reasonable period of time not exceeding 2 years to handle any questions related to the application, to contact them regarding other employment opportunities and for legitimate business interests.

Regarding the personal data obtained through the Dexilion channels, Dexilion uses Cookies according to the Cookies Policy.

9. Security and confidentiality.

We are dedicated to the security of your information. In order to prevent unauthorized access or unauthorized disclosure of personal data, we have undertaken appropriate technical and physical measures and management processes to safeguard and secure the information we collect from you.

10. Email Domains Used for Communication

To ensure transparency and help our users identify legitimate communications from Dexilion, we use the following email domains for different types of messages:

• lastest.cloud: used for all email communications and support requests.

Please note that official Dexilion communications will only come from these domains. If you receive an email claiming to be from us but using a different domain, please exercise caution and verify its authenticity before responding or clicking any links.

11. Minors

The Services are not directed to individuals under 18. In this regard, and to the extent that Dexilion is not able to control whether or not users are minors, it shall be the parents and guardians who shall enable the necessary mechanisms to prevent minors from accessing the Website and/or providing personal data, and Dexilion shall not accept any liability in this regard.

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal information.

We have not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months. We will not sell or share personal information in the future belonging to website visitors, users, and other consumers.

California Residents

California Civil Code Section 1798.83, also known as the "Shine The Light" law permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are under 18 years of age, reside in California, and have a registered account with the Services, you have the right to request removal of unwanted data that you publicly post on the Services. Right to Limit Use and Disclosure of Sensitive Personal Information

We do not process consumer's sensitive personal information.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

• You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information.

We do our best to keep our privacy policy fully updated on a monthly basis. If we make changes, they will be clearly identifiable in a conspicuous manner (for example: we may communicate changes to you by email).
